GENERAL TERMS AND CONDITIONS
PLACING AN ORDER
By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with or unclear about any aspect of these terms, please contact one of our customer service advisors before placing an order with us either by telephone on 02078381020, by email at [email protected] .By placing an order via this website you are making an offer to Bobointheclouds Ltd. to purchase the goods detailed in your order upon the terms described in your order.
When you place an order, we will require your name, email address, credit/debit card, phone and address details. This information is required in order to process your request or inform you of acceptance of our order. A contact phone number is needed so that we can get in touch if there is a problem with your order. We may, unless you inform us otherwise, provide our couriers with your contact phone number in case they need to reach you to arrange the delivery of your order.
After placing an order online, we will provide you with confirmation that your order has been received but this is not confirmation that your offer to buy the items has been accepted. Our contract for the sale of our products will only exist once an order has been accepted, processed and despatched to you.
Please note that we will not be able to meet any obligations as a result of the following reasons:
· -If the product you ordered is out of stock
· -We are unable to authorise your payment
· -If it is identified that there is a product description or pricing error
· -If customers do not reach any order criteria outlined in the Terms & Conditions
· -If our delivery companies are temporarily unable to deliver due to exceptional conditions that are beyond our control including hazardous weather and accidents.
Prices and availability of goods are subject to change without notice. A delivery charge will be added to your order value where appropriate. Please see our delivery times and charges.
All dates quoted for delivery are estimated delivery dates only and may be subject to change. We can accept no liability for any loss or damage (whether direct or indirect) if delivery takes place at any time other than the estimated date for delivery. All orders received and accepted before 4pm will, subject to availability and where possible, be dispatched on the following day for a 5 working day delivery. Those orders received and accepted after 4pm will be deemed as received the following day and will be dispatched the day after.
CONFORMITY OF GOODS
We take every care to ensure that the description and specification of our products are correct at the time of going to press. However, specifications and descriptions of products on this website are not intended to be binding and are intended only to give a general description of the products. Furthermore, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used to view the products.
STOCK AVAILABILITY
We endeavour to display through this website all items in our current range. We aim to hold stock of all styles and sizes whilst a product is active. However, occasionally an item will be out of stock and if this is the case this will be highlighted in your shopping basket. The stock status for your order will also be shown on your order confirmation.
YOUR RIGHT TO CANCEL
You have a right to cancel your order in writing within seven days of receipt and receive a refund of all charges. You will then need to return the item(s) either to our store or by post. Parcels returned by post are returned at your own cost.
GIFT SERVICE
We will endeavour to wrap your item as requested. Some items are too large and we will not be able to gift wrap them. Where you have asked us to use only one box or bag we will endeavour to do so, however, if the items will not fit and we have to use more than one, you will be charged for each box/bag used.
RETURNS POLICY
While we hope that you will be delighted with the quality and design of the items you have ordered, we appreciate that sometimes you may want to return some items. Under the United Kingdom’s Distance Selling regulations, you have the right to cancel your order for a full refund for any item purchased from BOBOINTHECLOUDS Ltd.
Terms and conditions apply:
- As a customer you have a duty of care towards the item you have purchased.
- Order cancellation must be made in writing by email, quoting your order number, within 7 working days of the day after you receive the goods at [email protected]
- Items must be returned to us within 14 working days . Items should be mailed to Bobointheclouds, 29 Elystan street , London SW3 3NT
- Good must be unused, unopened, in perfect condition (including original packaging) and remain in re-sellable condition. Bobointheclouds Ltd. Reserves the right to deduct 20% of the original value of any items returned for a refund that we received scratched or dismantled.
- Refunds do not apply to the original cost of postage, packaging and gift-wrapping selected at the time of the original order
- We cannot exchange or accept returns for items that have ben used, soiled, dismantled or partially put together.
- Please keep all packaging, spare parts & instructions and return the goods as they were received by you.
- Items returned beyond 14 days cannot be refunded but may be exchanged at our discretion
- When an item has been personalized we can only accept a return if there is a fault or a quality problem
- Outlet items are not returnable and not refundable
We cannot accept liability for goods lost or damages in transit, therefore we strongly recommend that you obtain a FREE” Certificate of posting” from the Post Office. For extra peace of mind ,you may want to return the goods to us by Recorded delivery.
Unfortunately, we are unable to refund the return postage. On your first exchange, Bobointheclouds wiil cover the cost of standard postage to send the exchanged good to you. Subsequent exchanges will be charged at our standard delivery rate.
Refunds will be processed within 28 working days of receiving the goods back from you. The payment will be made via your original method of payment. When returning goods on which you have received a discount/special offer that offer/discount will no longer apply and will be deducted from the original price.
DAMAGES
Although we do our best to ensure that the item(s) you have ordered are well-packed when leaving our warehouse, we rely on third party companies to deliver the parcel to your front door and sometimes accidents happen in transit. If you have received a damaged item, please accept our sincere apologies for the inconvenience. To ensure a smooth replacement, please follow the following steps:
-Notify our customer service within 48 hours of receiving the item at [email protected]
-Email us a photo of the damaged item(s) quoting your order/ invoice number
We will aim to send you a replacement within 2 to 3 weeks subject to stock availability.
PRICES
All prices quoted on this website are accurate at the time of publication, are quoted in pounds sterling and are inclusive of UK sales tax (VAT) at the current rate.
SECURITY OF PAYMENT
If your credit/debit card is used fraudulently as a direct result of being used to buy from our site, we will assume liability for the first £50 of your loss. Your credit card company is under obligation to take responsibility for the rest. We will use reasonable endeavours to work with your credit card company to minimise the hassle for you.
DISCLAIMER & LIMITATIONS OF LIABILITY
Bobointheclouds does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its members, agents, directors or employees or for any fraudulent misrepresentation. To the fullest extent permitted by law and save as provided above, neither Bobointheclouds Ltd. nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Bobointheclouds or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.
The limitations of liability in these conditions shall apply equally for the benefit of Bobointheclouds (U.K.) Limited and any other associated company of bobokids Ltd. ( XXXX ) as if references to Bobointheclouds included references to each such associated company.
